Terms & Conditions

These terms govern your use of this website and the GFG funding application. Please read them, particularly section 15, which requires most disputes to be resolved by individual arbitration.

1. Acceptance of these terms

These Terms & Conditions are an agreement between you and GFG ("GFG", "we", "us", or "our"). By visiting this website, using the estimate tools, or submitting a funding application, you accept these terms and our Privacy Policy. If you do not accept them, do not use the site.

If you accept these terms on behalf of a business, you represent that you are authorized to bind that business, and "you" means both you and that business.

Separate from your funding agreement. These terms cover your use of this site. If GFG funds you, that transaction is governed by the signed agreement for it — a purchase and sale of future receivables agreement, note, or similar document. If anything in that signed agreement conflicts with these terms, the signed agreement controls for that transaction.

2. Who may use this site

This site is intended for businesses located in the United States and for the adults who own and operate them. To submit an application you must be at least 18 years old, be an owner or officer authorized to act for the business, and be seeking funding for business purposes only. We do not offer consumer credit, personal loans, or household financing, and we do not fund businesses in jurisdictions where doing so would be unlawful.

3. What this site does and does not do

This site describes our funding products, lets you estimate costs, and lets you submit an application. Nothing on it is an offer, a commitment to fund, a pre-approval, or a promise of any particular amount, rate, term, or timing.

Every application is subject to underwriting, verification, funding-partner availability, and applicable law. We may decline any application, withdraw an offer before funding, or change the terms of an offer at any time before documents are signed and funds are released. Timeframes such as "decisions in hours" and "funding in as little as 24 hours" describe what is typical for complete files, not a guarantee.

GFG acts as a direct funder for some transactions and as a broker for others, placing the transaction with a funding partner. Where we act as a broker, we may receive compensation from the funding partner. We will tell you which role we are playing in a given transaction on request.

Nothing on this site is legal, tax, accounting, or investment advice. Consult your own advisors before taking on financing.

4. Cash advances are not loans

A merchant cash advance is a purchase of a specified amount of your future receivables at a discount. It is not a loan, and the amounts described are not interest. A factor rate is not an interest rate or an annual percentage rate, and the two cannot be compared directly.

Because the purchased receivables are a percentage of what you actually collect, the time it takes to deliver them varies with your sales. There is no fixed maturity date for a true receivables purchase, and delivering them faster does not reduce the amount you owe unless your agreement says otherwise. Term loans, lines of credit, and equipment financing offered through GFG are credit products with their own separate terms and disclosures.

5. Applications and accuracy

You agree that all information you submit is true, accurate, and complete, and that you will promptly tell us if it changes while an application is pending. Submitting false information, or documents you know to be altered or fabricated, may constitute fraud, and we may report it to law enforcement, credit bureaus, and industry fraud databases.

You agree that you are not currently a debtor in a bankruptcy proceeding, that you have disclosed all outstanding advances and business debt, and that you will not take additional financing secured by the same receivables while an application or funded transaction is outstanding, except as your agreement allows.

You may submit an application through a broker or referral partner. If you do, you authorize us to communicate with them about it and to share the status and terms of your file with them.

6. Authorization to obtain reports

By submitting an application, you authorize GFG and its funding partners, service providers, and assignees to obtain business credit reports, bank and trade references, public records, and consumer credit reports on each owner and guarantor named in the application. You authorize this at application and at any time while a transaction is pending, outstanding, or being considered for renewal, collection, or review.

You also authorize your bank, payment processor, and accounting platforms to release records about your accounts to us, and you authorize us to verify any information by any lawful means. See our Privacy Policy for how these reports are used and when a hard credit inquiry occurs.

7. Estimates and the calculator

The payment calculator and the on-page estimates are illustrations only. They are generated from assumptions we choose — including an assumed number of business days per month and a representative range of factor rates — and not from your file. They do not reflect underwriting, do not include every fee that may apply, and do not constitute an offer.

Actual amounts, fees, holdback percentages, and estimated durations appear only in the offer and the signed agreement for your transaction. Where an estimate and a signed agreement differ, the signed agreement controls.

8. Electronic records and signatures

You consent to conduct business with us electronically. You agree that we may provide applications, disclosures, notices, agreements, and other records to you electronically — by email, through this site, or through an e-signature provider — and that your electronic signature has the same legal effect as a handwritten one under the federal E-SIGN Act and comparable state laws.

To receive electronic records you need a device with internet access, a current browser, a working email address, and the ability to open and save PDF files. You may withdraw this consent or ask for a paper copy of any record by contacting us; withdrawing consent may prevent us from continuing to process an application online. Tell us promptly if your email address changes.

9. Consent to be contacted

By providing a phone number, you agree that GFG, its funding partners, and its service providers may contact that number about your application, your account, and our products — by call and by text, including with automated dialing systems and prerecorded or artificial voice messages, even if the number is on a do-not-call registry. Consent to marketing contact is not a condition of obtaining funding.

Message and data rates may apply and message frequency varies. Reply STOP to end marketing texts and HELP for help. You may opt out of marketing email through the unsubscribe link in any message. We will continue to send transactional and servicing messages about a pending application or an open account. Calls may be monitored or recorded for quality and compliance; where a call is recorded, we tell you at the start of the call.

10. Acceptable use

You agree not to:

  • Submit an application in a name other than your own or your business's, or impersonate anyone.
  • Submit false, altered, or fabricated statements, returns, or identification.
  • Scrape, crawl, harvest, or bulk-download the site, or use it to build a competing product or dataset.
  • Probe, scan, or test the security of the site, or attempt to gain unauthorized access to any system or account.
  • Introduce malware, interfere with the site's operation, or place unreasonable load on it.
  • Use the site for any unlawful purpose, or for personal, family, or household financing.

We may suspend or terminate access for anyone who violates these rules, and we may preserve and disclose records where we believe it necessary to investigate a violation or comply with law.

11. Intellectual property

The GFG name, logo, and wordmark are our trademarks. The site's text, design, graphics, layout, and code are owned by GFG or our licensors and protected by copyright and other laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to view and use the site for the purpose of evaluating and applying for funding. You may not copy, reproduce, distribute, modify, or create derivative works from the site except as that licence allows. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us an unrestricted, royalty-free right to use them without any obligation to you.

12. Third-party services

The site links to and relies on services we do not control, including bank data aggregators, e-signature providers, payment processors, and analytics tools. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their availability, content, or acts, and a link is not an endorsement.

13. Disclaimer of warranties

The site and all content on it are provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, GFG disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, timely, secure, error-free, or that any estimate, figure, or timeframe shown is accurate or achievable.

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability and indemnity

To the fullest extent permitted by law, neither GFG nor its officers, directors, employees, agents, or funding partners will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, or the cost of substitute financing, arising out of or relating to your use of this site, whether based in contract, tort, statute, or otherwise, and whether or not we were advised of the possibility of such damages.

Our total liability for all claims relating to the site will not exceed one hundred United States dollars ($100). This limit does not apply to liability that cannot be limited by law, and it does not limit obligations set out in a signed funding agreement.

You agree to indemnify and hold GFG harmless from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your use of the site, your breach of these terms, or information you submitted that proves to be false.

15. Governing law and dispute resolution

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

Informal resolution first

Before starting a formal proceeding, you agree to contact us at funding@gfg.com and give us 30 days to resolve the dispute informally. Most matters are resolved this way.

Binding individual arbitration

If we cannot resolve it informally, you and GFG agree that any dispute arising out of or relating to these terms or your use of this site will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, seated in New York, New York, and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Class action waiver

Disputes will be arbitrated only on an individual basis. You and GFG waive any right to bring or participate in a class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one party's claims or preside over any representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — will proceed in court.

Exceptions

Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or confidential information. Nothing here prevents you from reporting a matter to a government agency. This section does not apply to a dispute under a signed funding agreement that contains its own dispute-resolution provision; that provision controls.

16. Changes and termination

We may change these terms at any time. The effective date at the top of this page shows when they were last revised, and changes apply from the date they are posted. If a change is material, we will post notice on the site. Using the site after a change takes effect means you accept the revised terms.

We may modify, suspend, or discontinue any part of the site at any time without notice, and we may terminate or restrict your access at any time. Sections 11 through 17, and any obligation that by its nature should survive, remain in effect after termination.

17. General provisions

  • Entire agreement — these terms and the Privacy Policy are the entire agreement between you and GFG about this site, and replace any earlier understanding about it.
  • Severability — if a provision is held unenforceable, the rest stays in force and the unenforceable provision is modified to the minimum extent needed to make it enforceable.
  • No waiver — our failure to enforce a provision is not a waiver of it.
  • Assignment — you may not assign these terms without our written consent; we may assign them to an affiliate or in connection with a merger, financing, or sale of assets.
  • No third-party beneficiaries — except for our funding partners and service providers with respect to sections 9, 13, and 14, these terms create no rights in anyone else.
  • Force majeure — neither party is liable for delays caused by events beyond its reasonable control.
  • Headings — section headings are for convenience and do not affect interpretation.

18. Disclosures

These disclosures apply to everything on this site and to any communication from us about funding.

  • Business purpose only. All products are extended to businesses for business purposes. They are not consumer credit and are not covered by consumer lending statutes such as the Truth in Lending Act.
  • Not a loan. A merchant cash advance is a purchase of future receivables, not a loan. Factor rates are not interest rates or annual percentage rates.
  • Illustrative figures. Amounts from $10,000 to $5,000,000, factor rates, holdback percentages, terms, and timeframes shown on this site are illustrative. Your offer depends on underwriting, your deposit and processing history, time in business, industry, credit profile, existing obligations, and applicable state law.
  • Direct funder and broker. GFG funds some transactions directly and arranges others through funding partners. Where we arrange a transaction, we may be compensated by the funding partner. That compensation is disclosed in the transaction documents.
  • Personal guaranty. Most transactions require a performance guaranty or a personal guaranty from one or more owners. A guaranty can make an individual personally responsible for amounts owed.
  • Credit reporting. Applying authorizes credit and background reports as described in section 6. We may report payment performance to business credit bureaus.
  • State commercial financing disclosures. California, New York, Utah, Virginia, and other states require standardized disclosures — including estimated APR or total cost of capital — to be delivered with a specific offer of commercial financing. Where those laws apply to your transaction, we provide the required disclosure with the offer. Those disclosures, not this website, govern the cost of a particular transaction.
  • No guarantee of approval. Submitting an application does not guarantee an offer, and an offer is not binding until documents are signed and funds are released.
  • Testimonials. Customer reviews shown on this site reflect the experience of the individuals quoted and are not a guarantee of any result. Results vary.
